WARRANTY: The manufacturer warrants (i) its title to the product,  (ii) that the product will materially conform to the manufacturer’s  specifications for the product, provided that the product has been stored and  used in strict accordance with manufacturer’s usage and storage instructions  as they are set forth in the product’s technical data sheets and/or on the  product’s website, and minor variations or deviations from COA (Certificate  of Analysis) do not constitute a breach, and (iii) that, to the  manufacturer’s knowledge, the product shall be delivered free of the rightful  claim of any third person for infringement of any U.S. or Canadian patent  covering the product, excluding claims relating to uses or combinations not  contemplated by the manufacturer. THESE ARE THE ONLY WARRANTIES THAT THE  MANUFACTURER MAKES AND ALL OTHER EXPRESS OR IMPLIED WARRANTIES, UNDER STATUTE  OR ARISING OTHERWISE IN LAW, FROM A COURSE OF DEALING OR USAGE OF TRADE,  INCLUDING WITHOUT LIMITATION, ANY OTHER WARRANTY OF FITNESS FOR A PARTICULAR  PURPOSE OR USE, ARE DISCLAIMED BY THE MANUFACTURER. IF ANY PRODUCT FAILS TO  CONFORM TO THE WARRANTIES DESCRIBED HEREIN, MANUFACTURER’S EXCLUSIVE  OBLIGATION AND BUYER’S EXCLUSIVE REMEDY SHALL BE LIMITED TO REPLACEMENT OF  THE NONCONFORMING PRODUCT, WITH REFUND ONLY AT MANUFACTURER’S EXCLUSIVE  DISCRETION. Manufacturer shall not be liable for any costs, including labor,  related to the removal or reapplication of any product. Any claim under this  warranty must be made by buyer to the manufacturer in writing within five (5)  days of buyer’s discovery of the claimed defect, but in no event later than  the expiration of the applicable shelf life of the product. Remedies do not  extend or renew warranty periods. IN NO EVENT WILL THE MANUFACTURER BE LIABLE  UNDER ANY THEORY OF RECOVERY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR  CONSEQUENTIAL DAMAGES , INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF  USE, DOWNTIME, BUSINESS INTERRUPTION, PUNITIVE DAMAGES, AND LEGAL COSTS, IN  ANY WAY RELATED TO, ARISING FROM, OR RESULTING FROM ANY USE MADE OF THE  PRODUCT. DISCLAIMERS AND LIMITATIONS APPLY TO ANY AND ALL CAUSES OF ACTION,  WHETHER IN CONTRACT, TORT, EQUITY, OR OTHERWISE.

If any provision of this limited warranty is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be     enforced.

This limited warranty is intended solely for the benefit of the Buyer and does not confer any rights or benefits on any third party.

Buyers must provide documentary proof of strict compliance with all manufacturer instructions as a precondition to any claim. Any evidence of misuse, alteration, improper storage, or improper use voids all warranty rights.
